PROTECTION OF CUSTOMER INFORMATION

 

Please be aware that ZipX is a product of IBC Bermuda Ltd, a Bermuda Limited Company (Hereinafter “IBCB Ltd.”) as such by accepting the terms of this agreement you are transacting with IBCB Ltd.  We understand the importance of privacy to our customers, visitors to our website and users of our mobile applications. For many years, our policy has been to treat what we learn about our customers as confidential. For example, we will not give or sell confidential or personal information about our customer to any third party not affiliated with their transaction, except as required by law or as necessary to provide IBCB Ltd. services to the customer.

 

We collect and store information about every package we handle so that we can efficiently provide the package delivery services demanded by our customers. We use information about our customers, their packages, and their shipping activity to provide or enhance the services we make available to our customers, to enhance our ability to communicate with our customers about additional services they may find of value, to satisfy our legitimate business interests (including performing trend analysis and market studies), to set prices, establish credit, fulfill a Contract of Carriage or Service Agreement, accomplish the billing function, and to comply with government regulations. Although government regulations vary in the many countries in which we operate, they frequently include the reporting of information to transportation safety, customs, and other regulatory agencies.

 

As we collect and use information about our customers, we may contract with vendors to assist us in processing that information. These vendors are required to maintain the confidentiality of the information and are restricted from using the information for any purpose other than helping to provide IBCB Ltd. services to our customers.

 

Some of the information collected by IBCB Ltd. is personal data or data which relates to an identifiable person. Examples of personal data are names, addresses, e-mail addresses, credit card numbers, and telephone numbers. We never sell information to third parties that could be used to specifically identify an individual customer or group of customers. Anonymized data, with all names, addresses and other personally identifiable information removed, is sometimes shared with third parties. Finally, we do provide personal data to government agencies as required by law or regulation.

 

In addition to the uses of the information described in the paragraphs above, we collect telephone numbers and email addresses in the event that we have to contact the shipper, or the shipment recipient, to resolve a question or provide shipment status information.  Email addresses are additionally used to communicate special offerings and company news that pertains to the customer.

 

SHIPMENT INFORMATION

 

Information, including personal information (name, address and phone number), provided as part of a shipping transaction represents a record of that business transaction and cannot be altered after the transaction is complete except as provided in the IBCB Ltd. Although we make reasonable efforts to limit access to our facilities and vehicles to authorized personnel, we are not responsible for maintaining the confidentiality of information that is printed and placed in plain view on a package or letter.

 

 

LINKS TO OTHER SITES

 

IBCB Ltd. provides links to external sites as a convenience to the user. The inclusion of any link does not imply IBCB Ltd.’s endorsement of the external site company, its web site, or the products and services it promotes and sells. IBCB Ltd. is not responsible for the privacy practices and or the content of such websites.

 

SECURITY AND INTEGRITY OF INFORMATION

 

We treat our data as assets that must be protected against loss and unauthorized access. We employ information security techniques to appropriately protect confidential information from unauthorized access by users inside and outside the company. Access to customer information is limited to those employees who have a legitimate business need for that information.

 

IBCB Ltd. Internet sites are currently located in the United States. IBCB Ltd. Internet sites, and their supporting systems, employ generally accepted information security techniques such as firewalls, access control procedures and cryptography to appropriately protect confidential information from unauthorized access.

 

RETENTION OF CUSTOMER INFORMATION

 

We retain information about customers as necessary for business purposes and as required by government regulation. For example, we retain information about packages, including names and addresses, so that we can provide proof of delivery information and to process claim requests. We carefully dispose of records and delete information when retention periods expire.

 

CUSTOMERS ARE RESPONSIBLE FOR PROTECTING INFORMATION AND SYSTEMS ON THEIR PREMISES

 

Some information about IBCB Ltd. customers and their packages is stored in shipping systems located on customer premises or via our mobile application. Customers concerned about the security of their information in these systems should secure it by activating passwords and using physical access controls. When these systems (hardware or software) are provided by IBCB Ltd., we provide tools to facilitate customer efforts to safeguard their information.

 

COOKIES

 

Cookies are small text files that a website can send to a user’s browser for storage on the hard drive. Cookies can make use of websites easier by saving status and preferences about a website. Most browsers are initially set to accept cookies but users can change the setting to refuse cookies or to be alerted when cookies are being sent.  Both of the websites ZipX.bm and ibcinc.com use cookies. A notification and acceptance option appears on the website header.  The cookie notification is as follows:

MOBILE DEVICE / MOBILE APPLICATION

 

As a customer of IBCB Ltd., we offer our mobile application ZipX.  When using the ZipX mobile application, you will have the option to allow access to your device features such as your photo gallery and your phone documents.  You may use your photo gallery or phone documents to conveniently upload invoices relating to your shipments.  There is an additional option to allow or not allow push notifications via the Mobile Device ID.  Push notifications will alert you of shipment information and service changes.  When you access the application for the first time, the application will ask permission to send Push notifications and access Photo Gallery and Phone documents. If you wish to opt-out from receiving these types of communications, you may turn them off in your device’s settings.  When using the mobile application, we ask for personal data such as your name, account number, email address, delivery address and billing address.  This allows you to log onto your account, receive customer service support specific to your account and shipments and receive important service updates. We also ask for your credit card details to process the registration fee. We do not store credit card details within the App or on our website or on our servers.

 International Bonded Couriers of Bermuda Ltd (“ZipX”, “we”, “our” or “us”) owns and operates the Site from a server in Bermuda. Our registered office is at 2 Church Street, Hamilton, Bermuda.

 We provide the Site for information and as a service to our customers solely within Bermuda. It is not intended for use outside Bermuda.

 We may discontinue or change the Site, including these Terms of Use, any Content or services available on the Site, at any time without notice. Changes take effect when posted to the Site.

All other products, company names or other marks appearing on this Site are the trademarks of their respective owners. Nothing contained in the Site should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademark displayed on the Site without prior written permission of ZIPX or other trademark owners.

 Using the Site will not give you a license to exercise any intellectual property rights, unless expressly stated.

Without limiting the foregoing, to the maximum extent allowed by law, our total liability to you, in contract, tort, statute or other theory of liability, arising in relation to the Site (including the Content and these Terms of Use) is limited to fifty (BM$50.00) Bermuda dollars.

 3.6 EXTENSION OF DEFENSES

 Every right, including right to be indemnified, exemption from liability and defense of whatsoever nature applicable to ZipX or to which ZipX is entitled hereunder extends to and for the benefit of the directors, officers, employees, agents, shareholders, affiliates, suppliers (including any party involved in creating, producing or delivering the Site or the Content), successors and assigns of ZipX.

 4.  SERVICE AVAILABILITY AND ORDERS / NO ADDITIONAL WARRANTY

 Our services and goods are available only in Bermuda and pursuant to rates, charges, terms and conditions in our standard Rates and Charges pages and/or contract for such services and goods, and are subject to change (including discontinuation) without notice.

 Some of our services and goods may not be available in all areas of Bermuda.

 Nothing on this Site shall be construed as being an offer by us, only as an invitation to treat.

 An e-mail order confirmation from us does not mean our acceptance of an order or confirmation of an order to supply or sell any service or good. We may need to verify information you provide and our ability to fulfil the request before accepting any order.

 We have the right, without prior notice:

 (1) to limit the quantity of any service or good you order;

 (2) to refuse you service.

 Nothing on the Site shall add to or change any contract for services or goods you may have with ZipX, its suppliers or affiliates. Nothing on the Site shall be construed as a further or additional representation or warranty.

 5.1 REGISTRATION AND CANCELLATION

 You may need to register with us to access certain parts of the Site, in which case:

 (1) you must give accurate and complete registration information and advise us of any changes;

 (2) you must safeguard any user name, password and account we give you;

 (3) you authorize us to assume that any person using the Site with your user name and password is either you or is authorized to act for you;

 (4) you agree to immediately notify us of any unauthorized use of your user name, password or account;

 (5) you agree to be bound by the terms of the Privacy Code and you consent to ZipX’s use of your information on the terms set out in the Privacy Code.

 You may cancel your registration at any time by notifying us.

 We may cancel your registration if you do not visit the Site for some time, or if we believe you have breached these Terms of Use, including any additional terms and conditions applicable to the part of the Site or service to which you have registered.

 After your registration is cancelled, we may delete any Content you posted or accessible only to you on or via that part of the Site.

 All terms and conditions that by their nature extend beyond the cancellation of your registration or termination of our agreement, including our disclaimers and limitations of liability and your obligations to pay any amount owed and to indemnify us, will survive cancellation of your registration or termination of our agreement.

 5.2 WHAT YOU MUST NOT DO OR COMMUNICATE

(3)     to access, or enable others to access, parts of the Site or Content to which you are not authorized to access, including the personal information of other users of the Site.

6.  PRIVACY

 6.1 COMMITMENT TO YOUR PRIVACY

For electronic transactions through the Site, we follow the “Standard for Electronic Transactions” appointed by the Minister under Bermuda ’s Electronic Transactions Act 1999.

For details on how we may collect, use and disclose personal data, please see our privacy code, which also governs your visit to this Site. You agree, through the use of this Site and for any registration on this site or electronic transaction that you acknowledge and accept the terms of the Privacy Code and consent to ZipX’s use of your information pursuant to the Privacy Code.

We are not responsible for the information handling practices of any linked Web sites. Links to third-party Web sites are not governed by our privacy code.

6.2 SECURITY SAFEGUARDS & CONFIDENTIALITY OF COMMUNICATIONS

Please note that communications sent over the Internet, particularly unencrypted e-mail, are subject to possible interception, loss, change or forging.

ZipX will not be responsible for any damages you may suffer from the transmission of confidential information that you make to ZipX or any third party, or request ZipX or any third party to make to you through the e-mail links provided or addresses given on the Site. ZipX is not responsible for any errors or changes made to, or loss or interception of, any transmitted information. Such transmission is at your own risk.

6.3 MONITORING OF CONTENTS YOU TRANSMIT

We may, but are not obligated to, monitor any material or Content residing on or transmitted to our server.

We may, without notice, change or remove any material or Content residing on or transmitted to our server that we, in our sole discretion, believe is unacceptable or violates the law or these Terms of Use.

We may, without notice, block or terminate your access to use the Site or any part of it to protect it or our services or if required by law or we, in our sole discretion, believe you are in breach of these Terms of Use.

7.  INDEMNITY

You agree to defend, indemnify and hold us, including our directors, employees, members and agents, harmless from any and all losses, claims, damages, liabilities, costs and expenses (including reasonable legal fees and expenses) related to or associated with your use of the Site or someone using your account and password or your or such user’s violation of these Terms of Use.

8.  DISPUTES AND APPLICABLE LAW

8.1 APPLICABLE LAW & GENERAL PROVISIONS

Any claim arising out of the Content or the use of the Site shall be governed by and construed in accordance with the laws of Bermuda, without giving effect to any principles or conflicts of law.

You irrevocably submit to the non-exclusive jurisdiction of the courts of Bermuda. If you use the Site from outside Bermuda, you do so at your own risk and you alone are responsible for complying with applicable laws.

These Terms of Use, together with any additional posted terms and conditions applicable to certain parts of the Site, constitute the entire agreement between you and us and supersede all prior agreements relating to the subject matter thereof.

Our failure to insist upon or enforce strict performance of any provision in these Terms of Use shall not be construed as a waiver of such provision or any right.

If any part of these Terms of Use or any additional terms and conditions applicable to certain parts of the Site is found by any court or tribunal of competent jurisdiction to be void, invalid or unenforceable, it shall be given effect to the greatest extent possible and the remainder will continue to apply.
